Leveraging Strategic Legal Leadership to Effectively Navigate the Evolving Healthcare Landscape

The Ritz-Carlton, Orlando was an oasis of calm in an otherwise busy location and was ideally suited to the gathering of Chief Legal Officers and General Counsel from a range of healthcare providers at the 2024 Healthcare Law & Compliance Institute.  It was a reunion of old friends, as well as an opportunity to make new connections, amidst a collegial environment conducive to learning, information exchange, networking, and palm tree views.

Having kicked off with a panel of experts providing critical insights, and exploring key updates and considerations in the healthcare law landscape, Day One discussions covered government regulations, from dealing effectively with whistleblowers and state scrutiny of healthcare transactions and non-compete provisions; working with physicians, including ensuring FMV based on the facts and circumstances of each agreement as well as alternative strategies for engaging providers; and drafting considerations for AI healthcare solutions. The day ended with a bang, with two phenomenal sessions: the “Lawyer and Leader”, an animated discussion that explored the HR lens on legal department talent management and leadership, and several engaging and sometimes boisterous roundtable conversations on Optimizing Legal Department Operations.

Day 2 is always a very full and fulfilling day. For our first session, we had a unique opportunity to engage with a health system Board Chair and Chief Legal Officer as they discussed contemporary challenges in Board Governance. Our last session explored what keeps the healthcare industry up at night post-pandemic. In between, participants engaged in discussions around two main themes which are no doubt keeping in-house counsel up at night: AI / Technology and Regulatory Compliance. The former category featured a lively session on health system technology co-development arrangements with vendors/partners, while AI was explored through an engaging panel session, an interactive Think Tank, and a highly thought-provoking, forward-looking session on Generative AI: Opportunity vs Risk.

As attending GCs, CLOs and Chief Compliance Officers seek to maintain a culture of compliance in a shifting regulatory and enforcement environment, they benefited from a range of highly relevant and informative discussions on finding and resolving compliance issues in transactions, steering through the evolving landscape of non-profit hospital tax exemption, surfing the new wave of antitrust enforcement, and navigating the self-disclosure quagmire.

As we approached the end of the Institute, two challenging sessions, “Rethinking Workplace Violence in the Healthcare Setting: A New Approach to an Old Problem”, and a “2024 Economic Outlook: Market Trends, Disruptive Forces, and Opportunity Amidst Accelerated Industry Change” provided a sombre tone. While challenging, these are also two critical topics for hospital and health system GCs and CLOs as they seek to address the chronic challenge of violence against frontline healthcare workers, as well as effectively guide their CEOs and Boards through continued uncertain economic conditions.

This dynamic, highly interactive, and well received Institute concluded with the always popular conversation around the evolving role of the healthcare GC and CLO: what are the qualities and skill sets in-house counsel must develop be most effective in their role to enable their organization to thrive in and respond to a continually evolving healthcare landscape? Phenomenal discussion with great audience interaction!

Over the course of the two-and-a-half-day event, the networking and connection was incredible.  The quality of the speaker faculty and the high levels of discussion amongst the attendees created fertile ground for learning and information exchange. Lastly, fantastic networking, delicious meals, and impeccable service under the Florida sun made for an incredibly valuable and memorable experience and attendees left the Institute feeling refreshed and renewed.
